CANCELLATION TERMS FOR ALL FIRST AID COURSES:
15 - 30 days notice: Option to transfer course date. Full charges apply.
14 or less days notice: Full charges apply.
These terms and conditions are between 1 APEX and the Customer. All dealings between 1 APEX and the Customer shall be governed by these terms and conditions which shall prevail over any others.
These terms and conditions and any contract formed pursuant to them may be varied provided any variation is confirmed in writing by an authorized representative of 1 APEX.
A binding contract will be formed when 1 APEX notifies its acceptance of a customer’s order for goods or services (the 'Contract').
EXTREME WEATHER OR OTHER EMERGENCIES
The health and safety of our clients and our instructors is always our number one priority. 1 APEX reserves the right to waive all fees for cancelling or moving your program, given special weather conditions and/or the health of our instructors that are beyond our control.
GROUP BOOKINGS INVOICING & PAYMENT
Depending on the account you have with 1 APEX you will either be required to pay at the time of booking, or an invoice may be emailed 30 days before the performance of the services (course start date). It shall be payable on whichever date is sooner, within 30 days of the invoice's date, or 14 days before the commencement of the earliest course. If the booking is made less than 14 days before a training course commencement, payment is due before the course commences.
OPEN COURSE BOOKINGS INVOICING & PAYMENT
Depending on the account you have with 1 APEX you will either be required to pay at the time of booking, or an invoice may be emailed 30 days before the performance of the services (course start date). It shall be payable on whichever date is sooner, within 30 days of the invoice's date, or 14 days before the commencement of the earliest course. If the booking is made less than 14 days before a training course commencement, payment is due before the course commences.
Open courses are number restrictive; therefore, the payment is considered due from the invoice date as the invoice is for the reserved seat and not physical attendance.
In the provision of a training course by 1 APEX, certificates to prove completion of the course may be withheld by 1 APEX until payment is made. No refund shall be given, and the full course fee shall remain payable should a candidate fail any course provided by 1 APEX and 1 APEX make no guarantee as to a candidate successfully passing any course. If a candidate does not attend the full course fee shall remain payable, and no refund shall be given. The Customer's responsibility is to ensure that a candidate is booked on and attends the correct course. If a candidate attends a course and payment has not yet been made, the Customer accepts that payment is overdue.
BOOKING CANCELATIONS.
Subject to paragraph 4, if the Customer wishes to cancel a booking, the Customer must notify 1 APEX in writing by e-mail (Subject 'Notice of Cancellation booking reference no: #####'). For the avoidance of doubt, the notice of cancellation will not be accepted by telephone.
If 1 APEX receives a Notice of Cancellation more than 10 working days before the course's commencement, a refund of any course fees paid shall be given minus a 20$ + GST administration fee.
If 1 APEX receives a Notice of Cancellation less than 10 working days before the course's commencement, the full course fee shall remain payable, and no refund shall be given. Alternatively, the Customer may send an alternative candidate to attend the course. The customer must still notify 1 APEX in writing to amend or cancel any booking. If a candidate does not attend a course without giving prior notice in writing, the full course fee shall remain payable, and no refund shall be given.
TRANSFER OF INDIVIDUALS ON OPEN COURSES
Only one transfer is permitted to an alternative classroom training session. However, this option is only possible, where at least 10 working days’ notice is given before the classroom training. Please note that unfortunately cancellations/transfers cannot be accepted over the phone and must be made in writing. To clarify, you must give a minimum of 10 working days’ notice in writing if you need to cancel (or transfer) a booking.
CANDIDATE SUBSTITUTION ON OPEN COURSES
Candidates can be substituted any time before the open course start date. Requests are to be sent by email quoting the booking reference number, original candidate name and replacement candidate name. Once the request has been actioned, an amended confirmation email will be sent.
Interest on overdue invoices may be charged (at the discretion of 1 APEX) until the date of payment and the Customer agrees to pay any reasonable expenses incurred by 1 APEX in pursuing any outstanding debt or debts due from the Customer.
Risk of loss shall pass on delivery, and all delivery times are estimates only.
1 APEX shall not be liable to the Customer whether in contract, tort (including negligence) or otherwise for any loss of profit; anticipated profits; revenues; anticipated savings; goodwill or business opportunity; or for any indirect or consequential loss or damage whatsoever or for any failure to comply with its obligations due to an event beyond 1 APEX's reasonable control. 1 APEX's aggregate liability to the Customer whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the total sum paid or payable by the Customer to 1 APEX under the Contract.
1 APEX reserve the right to cancel and/or amend course dates, times, contents and venues. Every effort will be made to give the Customer as much notice as possible and offer a reasonable alternative. If these are not satisfactory, 1 APEX shall refund in full the price of the course. No further compensation will be given.
Any written notice under these terms and conditions shall be served via email.
FIRST AID REQUALIFICATION CERTIFICATION
The customer's responsibility is to ensure that candidates attend the re-certification course while still holding proof of having a valid Standard First Aid certificate. If the certificate has passed its expiry date, a full 2-day Standard First Aid course will be required.
CERTIFICATION ACCREDITATION
Candidates completing the Standard First Aid or Emergency First Aid courses will receive a certification award card as proof of competence valid for 2 years accredited by The Lifesaving Society.

Standard First Aid (2 Days) is delivered; evaluated and quality assured to meet the guidelines set out by the (Workplace Hazardous Materials Information System or WHMIS) Regulation and meets the requirements of the Health & Safety (First Aid) Regulations 1981.

Emergency First Aid (1 Day) DOES NOT meet the guidelines set out by the (Workplace Hazardous Materials Information System or WHMIS) Regulation and meets the requirements of the Health & Safety (First Aid) Regulations 1981.
CERTIFICATION REPLACEMENT
For a replacement of an Emergency/First Aid certificate, client will be charged a fee of $15.00+ GST per certificate.
WEBSITE COURSE PRICE CLARIFICATION
Course prices detailed on the website will identify the additional GST and relate to courses within approximately a 60 km radius of Hamilton, Ontario. Should you require courses to be conducted outside of this radius travel and/or overnight charges will apply. Please include this in your request for a quotation.
If parking is not made available on-site a 30$ charge will apply for each day of the training.
UNPAID INVOICES
1 APEX will not issue certification until payment has been received in full.
1 APEX reserve the right to charge interest on late payments.
Invoices 45 days or more from invoice date are liable to interest and debt recovery costs. Interest shall be charged at a rate of 10% on the outstanding gross amount inclusive of GST (No GST is chargeable on the interest itself).
